AbhishekRodrick vs. Amity University of Kolkata and Anr. On 25 January 2021

Application – under art. 226 of Indian constitution.

In this case Ld. Petitioner MR. AbhishekRodrick is currently studying in 10th semester in amity university of Kolkata. He himself appeared in 10th from 8th promoted by universities on the basis of their internal exam. But later that concerned university himself conduct physical exam of 8thsemester which is barred by bar council of India.

The bar council of India already held that no physical exam should be held except final year exam in law colleges. Although Amity university is trying to get that risk of taking offline exam in this pandemic year. Hence this suit is filled by a final year law student as a Public interest Litigation. The re4spondent Amity University issuing that promoting all student except final year student on next semester based on their internal exam can affect their student.

The plaintiff further added that university can take exam after normalise the atmosphere or after reopening the universities and while the university taking online classes due to safety then how an offline exam is safe. Later court passes such order that the university should take all exam in online mode along with final semester if they have enough infrastructure. The petitioner actually worried because he has applied for masters in abroad universities where they sent a confirmation via letter but he can’t go and study without complete his current bachelor. And respondent directed to provide letters to the petitioner named Abhishek Rodrick with regards to the explanation of re-examination .So he can send concerned paper to the abroad universities.
